1.      The Contract

The contract between OUTBACK SHUTTERS AWNINGS AND BLINDS and the customer will be finalised once the following conditions are met:

  1. The customer has approved the official OUTBACK SHUTTERS AWNINGS AND BLINDS quotation by digital acceptance or in writing.
  2. OUTBACK SHUTTERS AWNINGS AND BLINDS has received the deposit payment, which amounts to 50% of the total quoted sum.

Once said conditions (1.1 & 1.2) are met, OUTBACK SHUTTERS AWNINGS AND BLINDS will authorise fabrication to begin and will contact the customer to schedule an installation date.

NOTE: Please be aware that any modifications to the original quotation specifications may result in additional charges. Modifications cannot be made after fabrication has commenced.

2.      Payment methods

Payment methods accepted include:

  1. Major credit cards
  2. Debit cards.
  3. Electronic funds transfer (EFT)
  4. Cash

Customer payment card details will be encrypted to ensure security, and authorisation for payment must be provided at the time of invoicing.

3.      Price

The customer is obligated to pay the amount indicated on the final quotation. Upon fulfillment of conditions 1.1 and 1.2, the final balance will be confirmed and due on the day of completion of the contracted job. All prices quoted include Goods and Services Tx (GST), with the GST value itemised separately in the quotation.

Quotation and invoice prices provided by OUTBACK SHUTTERS AWNING AND BLINDS are denoted in Australian Dollars (AUD).

NOTE: Please note that apart from the standard installation specified in the quotation, OUTBACK SHUTTERS AWNINGS AND BLINDS bears no responsibility for any electrical or other trade-related work association with the customer’s quotation, unless explicitly stated in writing within the standard quotation.

4.      Cancellations

Once an order for OUTBACK SHUTTERS AWNINGS AND BLINDS products is placed with the supplier or manufacturer, changes or cancellations are not possible. If a post-order cancellation is approved by management, OUTBACK SHUTTERS AWNINGS AND BLINDS reserves the right to retain cost incurred of products already ordered with the supplier or the manufacturer.

5.      Cancellations due to stock shortages

OUTBACK SHUTTERS AWNINGS AND BLINDS retain the right to cancel a customer’s order if:

  1. Insufficient stock is available for the ordered goods to be manufactured.
  2. The goods ordered have been discontinued, unbeknownst to OUTBACK SHUTTERS AWNINGS AND BLINDS.
  3. An error in pricing, typing, or systems has occurred within OUTBACK SHUTTERS AWNINGS AND BLINDS’s database and/or website.

If, due to reasons beyond OUTBACK SHUTTERS AWNINGS AND BLINDS’s reasonable control, a specific item cannot be supplied, the customer will be promptly notified. It is important to note that no discounts or compensation can be provided under these unforeseen circumstances. However, OUTBACK SHUTTERS AWNINGS AND BLINDS will present a selection of suitable alternatives or offer a full refund as options.

6.      Product descriptions and measurements

1.      Descriptions photos

The products highlighted on the OUTBACK SHUTTES AWNINGS AND BLINDS website, social media, quotations, brochures, and other marketing materials are accurately represented through photography or digital production. However, due to disparities in computer monitor styles, settings, and document printing, some colours may appear differently from the exact OUTBACK SHUTTERS AWNINGS AND BLINDS colour range. OUTBACK SHUTTERS AWNINGS AND BLINDS strongly recommends Customers request a sample before placing an order to ensure satisfaction with both colour and style. While every effort will be made to ensure goods align with Customer requirements, any minor variation or change in colour or description delivered does not entitle the Customer to reject the goods or claim compensation.

2.      Measurements

OUTBACK SHUTTERS AWNINGS AND BLINDS customises goods based on specific customer requirements and sizes. It is OUTBACK SHUTTERS AWNINGS AND BLINDS’s responsibility to accurately measure the custom dimensions before placing the order. Customers are required to review and confirm product details before OUTBACK SHUTTERS AWNINGS AND BLINDS proceeds with the manufacture or manufacturer’s order. OUTBACK SHUTTERS AWNINGS AND BLINDS cannot accept returns or offer refunds if customers alter any measurement parameters after confirming the quoted details.

3.      Made To Measure Products

Given that most OUTBACK SHUTTERS AWNINGS AND BLINDS products are ‘Made to Measure’ to meet precise customer requirements, once ordered, goods cannot be cancelled or returned. OUTBACK SHUTTERS AWNINGS AND BLINDS cannot be held responsible if customers dislike the colour, or style of the product after the order has been agreed to by digital acceptance or in writing and deposit has been paid. OUTBACK SHUTTERS AWNINGS AND BLINDS strongly recommends customers double-check their orders to ensure correctness.

7.      Supply Chain Lead Time & the delivering of the customer goods.

Notwithstanding points (5.1, 5.2, 5.3) please note that our Supply Chain Lead Time are as follows:

Internal and External Awnings & Blinds – 4 to 6 weeks from receipt of deposit

Shutters – 6 to 8 weeks from receipt of deposit

All Custom Colours and Special Shapes – 8 to 10 weeks from receipt of deposit

Although our supply chain lead times are typically met, occasional manufacturing issues with suppliers can extend them as listed above. As OUTBACK SHUTTERS AWNINGS AND BLINDS cannot control these events, refunds or financial compensation are not claimable. Nevertheless, OUTBACK SHUTTERS AWNINGS AND BLINDS will make every effort to expedite delivery and installation.

NOTE: The supply chain lead time does not start from the date of contract initiation but from the receipt of the deposit as listed 1.2. Additionally, these lead times are based on a landed period. OUTBACK SHUTTERS AWNINGS AND BLINDS will contact you to arrange installation at that point.

NOTE: Deliveries and installations are during normal trading hours Monday to Friday.

8.      Defective goods

9.      Representations

Statements, description, or recommendations found in any catalogues, price lists, advertisements, communications, or from any employee or agent of OUTBACK SHUTTERS AWNINGS AND BLINDS are not to be construed in a manner that expands, modifies, or overrides any of the terms and conditions outlined herein.

10.  Events beyond OUTBACK SHUTTERS AWNINGS AND BLINDS’s control

OUTBACK SHUTTERS AWNINGS AND BLINDS assumes no responsibility for non-delivery, delays, or alterations to specified delivery due dates to events beyond its reasonable control, including, but not limited to third-party defaults, strikes, industrial disputes, system breakdowns, sever weather, natural disasters, explosions, pandemics, or accidents. In such cases, OUTBACK SHUTTERS AWNINGS AND BLINDS will collaborate with the supplier to expedite the fulfillment of the order at the earliest opportunity.

11.  Invalidity

In the event that any portion of these terms and conditions is deemed unenforceable, including any provision where OUTBACK SHUTTERS AWNINGS AND BLINDS seeks to exclude liability, the enforceability of the remaining provisions will remain unaffected.

12.  Privacy

OUTBACK SHUTTERS AWNINGS AND BLINDS does not share, engage in the sale, trade, or rental of customers personal information to third parties.

13.  Consumer guarantee

Following Australian Consumer regulations, OUTBACK SHUTTERS AWNINGS AND BLINDS is obligated to deliver the ordered product to the customer. In the case of missing or incomplete parts, OUTBACK SHUTTERS AWNINGS AND BLINDS will promptly replace them in accordance with Consumer Guarantee standard. A refund will be issued only if replacement or repair is not feasible. OUTBACK SHUTTERS AWNINGS AND BLINDS is not liable for any installation charges incurred by the customer from engaging a third-party solution. It is important to note that the warranty becomes void if a person and/or company outside of OUTBACK SHUTTERS AWNNINGS AND BLINDS is chosen to rectify product faults.

14.  Additional charges

In addition to point 7.1, if the customer delays the final payment for a period of 7 days, OUTBACK SHUTTERS AWNINGS AND BLINDS reservices the right to impose a late fee of $55 per week until the final payment is made.
